The NFA registration injunction bars the Justice Department and ATF from enforcing challenged National Firearms Act registration and preapproval requirements against covered Gun Owners of America members and Silencer Shop customers under U.S. District Judge James Wesley Hendrix’s final judgment.
The injunction is party-specific. It does not apply to every gun owner, erase the NFA from federal law or decide the plaintiffs’ Second Amendment claims.
A tax law lost its constitutional footing
Congress reduced the NFA making and transfer taxes on suppressors, short-barreled rifles, short-barreled shotguns and certain other weapons to zero beginning January 1, 2026. Hendrix ruled that the government could no longer defend the challenged registration and approval provisions as tools for collecting those taxes.
The memorandum opinion says the provisions exceed Congress’ enumerated powers as applied to the plaintiffs. The final judgment permanently protects the organizations and, where applicable, their political subdivisions, members and customers.
For customers, the protection is tied to transactions with the plaintiff commercial entities or commercial members. It does not cover every NFA-regulated firearm a customer might possess.
What the NFA registration injunction changes now
The judgment carried a seven-day stay so the government could seek appellate relief. The public docket showed no notice of appeal or additional stay when checked Thursday morning. The injunction therefore took effect for the covered parties, subject to later appellate action.
Silencer Shop says covered customer transactions no longer require the federal Form 4 registration process or its associated wait. That is the plaintiff’s explanation of the order, not individualized legal advice. State restrictions and ordinary federal background checks still apply.
Gun Owners Foundation called the ruling a major victory. Giffords, a gun-control organization, told the Associated Press that NFA registration had provided notice to local law enforcement and a heightened background check. AP reported that more than 6.4 million suppressors were registered as of June, citing ATF.
Senate pushes the funding fight to December
The Senate passed H.R. 6500 by 90-6, extending current federal funding through December 11 and sending the measure to the House.
The stopgap avoids an immediate shutdown if the House approves it. It does not complete the annual appropriations process or reduce current spending. The Associated Press reports that House action will wait until lawmakers return after Labor Day.
The practical result is another temporary extension. Taxpayers get continuity, not a final budget settlement, and the full funding dispute moves beyond the midterm election.

Secretary of State Denny Hoskins rejected the petitions. The challengers want those decisions reversed. The schedule is settled for now; the legal merits are not.
